How to Report Fly-Tipping – Illegal Dumping on Private Land
If you have been the victim of fly tipping, check your local council website for details on how to report it. If you witness fly-tipping in real-time or have details which may lead to the identification of the perpetrator, call 101 to speak to Police Scotland directly.
If the unlicenced waste is believed to be hazardous waste or is near to a watercourse, the local authority may decide to involve the police themselves or to contact SEPA or a similar environment agency.
Remember, the deposit of ANY waste onto land can be classed as fly-tipping and it is always worth reporting to the local authorities.
Is Fly Tipping a Criminal Offence?
Fly tipping is a criminal offence in Scotland, with the primary legislation covering the dumping of unlicenced waste being the Environmental Protection Act 1990 (EPA 1990), Sections 33, 34 and 59.
What is the Maximum Fine for Fly-Tipping? – Illegal Waste Dumping Penalties
The maximum fine for fly-tipping in Scotland is £40,000. Fly tipping fines can vary significantly, from £500 fixed penalties for smaller offences to more severe punishments if the case goes to court. Alongside fines ranging into the thousands, someone who is convicted of fly tipping could face imprisonment of up to 12 months.
